Terms of Service

These terms are the agreement between you and Big Little Business, LLC ("we," "us"), which operates VDO Artist at vdoartist.com. By using the site, you agree to them. If you don't agree, please don't use VDO Artist.

1. What VDO Artist is

VDO Artist is a place where independent video artists share their work. Anyone can watch for free without an account. Viewers may choose to support an artist with a donation of any amount. Videos that fans support most rise in the rankings.

2. Who can use VDO Artist

• Anyone may watch videos. VDO Artist is not directed to children under 13.
• To open an artist account, you must be at least 18 years old and able to enter a binding agreement.
• One artist account per person. You're responsible for keeping your password safe and for everything done through your account.
• Donors must be 18 or older, or have permission from a parent or guardian who owns the payment card.

3. Your videos belong to you

Every video uploaded to VDO Artist belongs to the artist who made it, and solely to that artist. We claim no ownership of any artist's work, and we never sell, license, or use it anywhere outside VDO Artist.

To run the site, you give us a limited, non-exclusive, royalty-free permission to store your video and show it on VDO Artist. That includes making streaming versions (1080p, 720p, and 480p), creating a thumbnail, and delivering it to viewers through our hosting providers. This permission ends when you delete the video, except for brief backup copies that are cleared in the normal course of operation.

By uploading, you confirm that you made the video or have permission for everything in it, including music, footage, and the people who appear in it.

4. Content rules

VDO Artist is for original creative video suitable for a general audience. You may not upload, or receive donations for:

• Nudity, pornography, or sexually explicit or suggestive content of any kind.
• Any sexual content involving minors. We report it to the National Center for Missing & Exploited Children and law enforcement, and the account is closed permanently.
• Graphic violence, gore, or content that promotes self-harm.
• Hate speech toward any group based on race, religion, disability, gender, sexual orientation, national origin, or any other immutable characteristic; harassment, threats, or content targeting private individuals.
• Violent extremism: content that engages in, encourages, promotes, or celebrates unlawful violence or terrorism.
• Content you don't own or have permission to use.
• Scams, spam, misleading titles or thumbnails, or links to malicious software.
• Anything illegal or that promotes illegal activity.

5. Moderation and enforcement

We may review, hide, or remove any video, and suspend or close any account, at our discretion to keep VDO Artist safe. New artists' first videos are reviewed before they go public, and any viewer can report a video. Rule violations earn strikes: 1 strike removes the video with a warning, 2 strikes pause uploads for 14 days, and 3 strikes within 12 months closes the account. Illegal content results in an immediate permanent ban. You may appeal a removal once by emailing [email protected].

6. Copyright complaints

If you believe a video on VDO Artist infringes your copyright, email [email protected] with: your contact information; a description of the work you own; the link to the video on VDO Artist; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will remove the video and notify the artist, who may send a counter-notice. Repeat infringers lose their accounts.

7. Donations

• Donations are voluntary gifts to support an artist. You don't receive goods or services in return.
• Donations go to individual artists, not to a charity, so they are not tax-deductible.
• Payments are processed by Stripe. Your card details go directly to Stripe and never pass through or are stored on VDO Artist.
• Donations are final. If you believe a charge was a mistake or unauthorized, contact us at [email protected] and we will help.

8. Payouts to artists

• To receive donations, artists set up a payout account with Stripe, which verifies their identity. By doing so, artists also agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement.
• Each donation is paid to the artist minus a 8% platform fee and card processing costs. Stripe pays artists on its regular payout schedule.
• If a donor's bank reverses a charge, that amount may be deducted from the artist's balance.
• Artists are responsible for their own taxes on donations they receive. Stripe may issue tax forms to artists who meet reporting thresholds.

9. Fair play

Don't try to fake support. That means no donating to your own videos, directly or through others; no donation swaps; no bots or paid thumbs; and no prizes or refunds in exchange for support. We may exclude faked support from rankings, withhold affected payouts where permitted, and close accounts that break these rules.

10. Messages between fans and artists

Artists can choose to receive messages from viewers, for example about hiring them or working together. Messages are sent through VDO Artist so that personal contact details stay private:

• Messaging is off unless an artist turns it on, and an artist can turn it off at any time.
• A sender never sees the artist's email address or phone number. The artist sees only the name, email address, and message the sender provides, so they can decide whether to reply.
• If an artist replies, they do so from their own email, and the sender will then see that address. Replying is always the artist's choice.
• Messages must follow the same content rules as videos. No spam, harassment, threats, solicitation of personal information, scams, or links. Senders are limited to a few messages a day.
• Artists can block or report any sender. Reported messages are reviewed by moderators, who can ban a sender from messaging anyone on VDO Artist.
• Any work, payment, or agreement arranged between a fan and an artist is between them. Big Little Business, LLC is not a party to it and is not responsible for it. Use good judgment, and never send payment or personal details to someone you don't trust.

11. Our service

VDO Artist is provided "as is." We work to keep it running and secure, but we can't promise it will always be available or error-free, and we may change or discontinue features. To the fullest extent permitted by law, Big Little Business, LLC is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the greater of $100 or the platform fees we received from you in the 12 months before the claim.

You agree to defend and hold harmless Big Little Business, LLC from claims arising from content you upload or your violation of these terms.

12. Ending your account

You can delete your videos at any time in My Studio. To close your account entirely, email [email protected] from your account's email address. We may suspend or close accounts that violate these terms.

13. Changes

We may update these terms. If we make significant changes, we'll post them here with a new date and, for artists, notify you by email or in My Studio. Continuing to use VDO Artist after changes means you accept them.

14. Governing law

These terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Idaho.
